These terms and conditions (hereinafter: "Terms and Conditions") define the rules for posting reviews and using the product rating tool for products offered in the PATIO.garden online store (hereinafter referred to as the "Review Tool") provided by DAJAR sp. z o.o. with its registered office in Koszalin, ul. Połtawska 6, 75 – 072 Koszalin, entered into the Register of Entrepreneurs of the National Court Register kept by the District Court in Koszalin, 9th Commercial Division of the National Court Register under KRS number 0000006818, having NIP number 6692296668 and REGON number 00380067500000 (hereinafter referred to as "DAJAR").

Technical support for the Review Tool is provided by our service provider Yotpo, however, DAJAR is responsible for the content.

§ 1 General Provisions

1. Your product review is information (a statement) sent via the received link, using the Review Tool, strictly related to your subjective view of the subject of the statement (hereinafter: "Review").

2. A product review can only be added by a customer who has purchased products offered in the PATIO.garden online store.

3. By submitting a product Review via the sent link, using the Review Tool, you confirm and accept the terms of the Terms and Conditions, while undertaking to comply with them.

§ 2 Rules for Publishing Reviews

1. For a Review to be published, it must be written in Polish, maintaining the rules of correct Polish language.

2. In order to publish a Review, you must use the link received after purchase. The Review is expressed by rating the product offered in the PATIO.garden online store using stars. Additionally, you can fill in the descriptive field "Product Review". The Review will be sent after confirming it with the "Send Review" button.

3. By submitting a Review, you confirm that:

• You have actually purchased the rated product from DAJAR and used it;

• You wrote the product Review yourself and are the sole author of the content;

• Your review relates exclusively to the purchased product and its properties;

• To the extent that your product Review contains statements of fact, they are true;

• You are at least 18 (eighteen) years old;

• You have not received payment or any other direct benefit from third parties (e.g., manufacturers) for writing the Review, unless clearly stated in the content of the Review;

• Your Review does not violate the rights of third parties (e.g., copyrights, trademark rights, personal rights) or trade secrets;

• Your Review does not violate applicable laws (e.g., unfair competition law) and does not contain sensitive data of other persons within the meaning of data protection regulations;

• Your Review does not contain malicious software (viruses, Trojans, etc.).

4. The possibility of posting a Review for a purchased product is limited in time. A Review can be posted within 6 months from the date of purchase. After this period, the rating link and the rating option in the customer account expire, and thus technical addition of a Review is no longer possible.

5. We are not obliged to publish every submitted review. We reserve the right to verify reviews before or after publication. If a review violates these Terms and Conditions, we have the right not to publish it or to remove it at any time. Since you receive the rating link only after an actual purchase, published reviews are marked as "Verified Purchase".

6. DAJAR reserves the right to refuse publication of a Review if the content of the Review violates the provisions of the Terms and Conditions, as well as when:

• Your Review contains offensive, vulgar, defamatory, discriminatory, racist, sexist, pornographic, violence-glorifying, or political content;

• Your Review is contrary to the law or good customs;

• Your Review violates the rights of third parties, including in particular copyrights, trademark rights, personal rights, trade secrets, or those related to confidentiality obligations;

• Your Review violates applicable laws, i.e., in particular unfair competition laws, or contains sensitive data of other persons within the meaning of data protection regulations;

• Your Review contains advertisements, spam, links to other websites, or contact details (addresses, e-mails, phone numbers);

• Your Review does not relate in whole or in part to the purchased product.

7. The content of the Review may be made available to entities entitled to receive them under applicable law, including relevant law enforcement or judicial authorities.

8. Important information regarding data protection: In principle, we publish your Review providing only your first name and the first letter of your last name (e.g., "Max M.") to protect your privacy. Your full last name will not be published.

9. We reserve the right to editorially process reviews (e.g., shortening or correcting typos), as long as it does not change the meaning of the statement.

§ 3 Copyright - Granting of rights to use (license)

1. By submitting a Review, you grant DAJAR a time-unlimited license for free use, dissemination, publication, copying, modification, and distribution of any submitted Reviews (text and possibly photos).

2. Based on the granted license, DAJAR is entitled to:

• publishing, reproducing, and disseminating your Review in connection with the rated product in the DAJAR online store by making it publicly available in such a way that everyone can have access to it at a place and time of their choice (Internet), public display and republication, in particular in DAJAR's channels, social media, and marketing materials;

• recording and multiplying your Review – i.e., producing copies of the Review using any technique, including printing, reprographic, magnetic recording, and digital techniques.

3. As part of the granted license, you consent to the use of the Review in any parts, the use of the work or any part thereof for the purpose of promotion and advertising of DAJAR. At the same time, by granting the license, you ensure DAJAR that the Review is original and is the result of your own intellectual work, and does not violate the copyrights of third parties. In case of untruthfulness of the above statements, you bear responsibility towards third parties for the violation of their rights.

§ 4 Final Provisions

1. DAJAR reserves the right to contact you regarding the posted Review.

2. Based on these Terms and Conditions, you are responsible to DAJAR for complying with the obligations resulting from its content. If third parties bring claims against DAJAR resulting from an unlawfully written Review by you (e.g., copyright infringement or insult), you undertake to release us from these claims and cover reasonable legal defense costs.

3. These Terms and Conditions are effective from the date of their publication on the PATIO.garden website.

4. DAJAR is entitled to change these Terms and Conditions. The amended Terms and Conditions are effective from the date of their publication on the PATIO.garden website.
