Right of Withdrawal for Consumers

(A consumer is any natural person who enters into a legal transaction for purposes that are predominantly not attributable to their commercial or independent professional activities.)

Right of Withdrawal

You have the right to withdraw from this contract within one month without stating a reason. The withdrawal period shall be one month from the day,

• on which you or a third party designated by you, who is not the carrier, took possession of the goods, provided that you ordered one or more goods as part of a single order and these are delivered uniformly;
• on which you or a third party designated by you, who is not the carrier, took possession of the last good, provided that you ordered multiple goods as part of a single order and these are delivered separately;
• on which you or a third party designated by you, who is not the carrier, took possession of the last partial delivery or the last piece, provided that you ordered a good that is delivered in several partial deliveries or pieces;

To exercise your right of withdrawal, you must inform us (Dajar GmbH, c/o. Regus, Unter den Linden 21, 10117 Berlin, Telephone No.: +4915775579795, Email address: [email protected]) by means of a clear declaration (e.g., a letter sent by post or an email) about your decision to withdraw from this contract. You can use the attached sample withdrawal form, which is not mandatory.

To meet the withdrawal deadline, it is sufficient for you to send the communication regarding the exercise of the right of withdrawal before the withdrawal period expires.

Consequences of Withdrawal

If you withdraw from this contract, we shall reimburse you for all payments we have received from you, including delivery costs (except for additional costs resulting from your choosing a type of delivery other than the least expensive standard delivery offered by us), promptly and at the latest within 14 days from the day on which we receive the notice of your withdrawal from this contract. For this reimbursement, we will use the same payment method that you used in the original transaction, unless expressly agreed otherwise with you; under no circumstances will you be charged fees for this reimbursement.

We may refuse the reimbursement for goods suitable for parcel shipping until we have received these goods back, or until you have provided evidence that you have sent these goods back, whichever is earlier.

We will collect goods that are not suitable for parcel shipping.

You must return or hand over goods suitable for parcel shipping promptly and in any case no later than 14 days from the day on which you notify us of the withdrawal from this contract to us or to Dajar GmbH c/o Schenker Deutschland AG TNL, Herr Thews, Frau Lenz, Schwanenfeldstraße 11, 13627 Berlin, GERMANY. The deadline is met if you send the goods suitable for parcel shipping before the 14-day period has expired.

You bear the direct costs of returning goods suitable for parcel shipping. We bear the costs of returning goods not suitable for parcel shipping.

You are only liable for any diminished value of the goods if this reduction in value is due to handling of the goods which is not necessary for checking their condition, properties, and functionality.

Exclusion or Premature Expiry Reasons

The right of withdrawal does not apply to contracts

• for the delivery of goods that are not prefabricated and for whose production an individual selection or determination by the consumer is decisive or which are clearly tailored to the personal needs of the consumer;
• for the delivery of goods that can spoil quickly or whose expiration date would be quickly exceeded;
• for the delivery of alcoholic beverages whose price was agreed at the time of contract conclusion, but which can be delivered no earlier than 30 days after contract conclusion and whose current value depends on fluctuations on the market over which the entrepreneur has no control;
• for the delivery of newspapers, periodicals, or magazines, except for subscription contracts.

The right of withdrawal expires prematurely for contracts

• for the delivery of sealed goods that are not suitable for return for reasons of health protection or hygiene, if their sealing was removed after delivery;
• for the delivery of goods if these were inseparably mixed with other goods after delivery due to their nature;
• for the delivery of audio or video recordings or computer software in a sealed package, if the seal was removed after delivery.
